1. Agreement to Terms

By accessing or using Eventilly ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Eventilly is operated from Australia and these Terms are governed by the laws of Australia, including the Australian Consumer Law.

2. Description of Service

Eventilly is an AI-powered event planning platform that helps users:

• Generate event plans and task lists using artificial intelligence
• Discover local vendors through integrated search functionality
• Organize and manage event planning tasks

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Credits and Payments

The Service uses a credit-based system for certain features:

• Free credits: May be granted upon signup and expire 30 days from the date granted
• Purchased credits: Expire 30 days from the date of purchase
• Credit costs: Vendor searches cost 1 credit; loading additional results costs 0.25 credits
• Payments: Processed securely through Stripe. All prices are in USD unless otherwise stated

By purchasing credits, you agree to pay the applicable fees. All sales are final unless otherwise specified in our Refund Policy.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Harass, abuse, or harm other users
• Upload malicious code or content

6. AI-Generated Content

The Service uses artificial intelligence to generate event plans and suggestions. You acknowledge that:

• AI-generated content is provided as suggestions only and may not be accurate
• You are responsible for reviewing and verifying all generated content before use
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• Budget estimates are approximations and may vary significantly from actual costs

7. Third-Party Vendors

The Service provides information about third-party vendors through Google Places API. You acknowledge that:

• We do not endorse or guarantee any third-party vendors
• Vendor information is sourced from Google and may not be current or accurate
• You are responsible for verifying vendor credentials before engaging their services
• Any transactions with vendors are solely between you and the vendor
• We are not liable for any disputes, damages, or issues arising from vendor interactions

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Eventilly and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you create using the Service, including your event plans and customizations.

9. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

• The Service is provided "as is" without warranties of any kind
• We do not warrant that the Service will be uninterrupted, secure, or error-free
• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim

Nothing in these Terms excludes or limits any consumer rights that cannot be excluded or limited under Australian Consumer Law.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or the Service shall be resolved in the courts of Australia.
